After the revolution, prior to the current constitution, the U.S. was governed by the articles of confederation, which provided that the Union would be perpetual and did at least mention territories (Quebec) and also was in my opinion a treaty between states. http://www.usconstitution.net/articles.html
The confederal government under the articles lacked power to tax and was very weak.
