The problem with any study of constitutional law is it is a huge subject. I am presenting the aspects of U.S. constitutional law most relevant for German lawyers. So for example today’s lesson is the fascinating topic of the interaction between the U.S. Constitution and International law. We will also be looking at the structure of fundamental rights, the problem of third party effect and direct effect (Drittwirkung, unmittelbare Anwendbarkeit) and the resolution of conflicts between fundamental rights (proportionality). We have, to present, looked at federalism and separation of powers, as well as interpretation and interpretivism versus originalism. Those themes will recur throughout the course. If we have time we will also look at jurisdictional and procedural limitations – I think we will.
